Interference with Contracts (Tortious Interference)
The ability to secure and maintain contracts is essential to the long-term success of any business. Understanding the damage that can be done if these contractual relationships are disturbed, Texas law recognizes a cause of action for tortious interference with a contractual relationship. Tortious interference with a contract occurs when a third party willfully and intentionally interferes with an existing contract or seeks to prevent the execution of a contract and the tortious interference results in actual damage or loss.
While not all interference creates a cause of action, a successful claim for tortious interference can result in an award of lost benefits under the contract, mental anguish, injury to your reputation, lost profits, pre and post judgment interest and possibly punitive damages.
