Texas Deceptive Trade Practice Act (DTPA)
The Texas Deceptive Trade Practices Act (“DTPA”) is a far-reaching law that protects consumer’s rights and assures you are dealt with fairly in consumer transactions. The DTPA contains a number of acts that can form the basis of a claim including:
- Passing off goods or services as those of another
- Falsely representing goods or services
- Falsely disparaging the goods or services of another business
- False advertising
- Fraud by repairpersons (i.e. mechanic’s shops)
- Motor vehicle Fraud
- False warranties
- Failure to disclose certain information in sales of goods and services
- Falsely representing business entity status
- Price gouging after a disaster
When you buy or lease any type of product in Texas, you have the legal right to expect the product to be fairly and accurately described, advertised and offered to you. From cars and other motor vehicles to home furnishings, electronics, clothing and all types of consumer services, the DTPA is in place to protect you. If it is proven that you have been willfully or intentionally deceived in a consumer transaction, you could be entitled to up to three times the amount of actual economic damages and compensation for mental anguish or other consequences caused by the deceptive act.
